Welcome to AlienAlerts.com (the "Website" or "Platform"), operated by Alien Alerts LLC ("we," "us," or "our").
By accessing or using the Website, any associated mobile applications, or services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Services.
1. Description of Services
AlienAlerts.com is a decentralized citizen platform for documenting and responding to non-human threats, including unidentified aerial phenomena (UAP/UFO), abductions, missing-time events, intrusions, and related anomalies.
The Platform includes:
- Real-time reporting of sightings and events (with GPS and evidence upload)
- Neighborhood alerts and community notifications
- Astronomy tools (star maps, LST clock, etc.)
- Right-mindedness and defense resources
- SOS broadcast functionality
We offer free Observer accounts (limited access) and paid Reporter memberships (full posting and advanced features). Current pricing and membership details are available on the Website and subject to change.
2. Eligibility and Accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Services.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- You agree to provide accurate, current, and complete information when registering or updating your account.
3. Membership and Payments
- Reporter membership is currently priced at $10 per year (subject to change with notice).
- Payments are processed through secure third-party providers.
- Memberships automatically renew unless canceled in your account settings prior to renewal.
- Refunds are generally not provided for partial membership periods, except where required by applicable law.
- We reserve the right to modify pricing, features, or membership tiers at any time.
4. User Content and Reports
You retain ownership of any content you submit ("User Content"), including reports, photos, videos, descriptions, and comments.
By submitting User Content to the Platform, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purposes of operating, improving, promoting, and maintaining the Services.
You represent and warrant that:
- Your User Content is truthful and accurate to the best of your knowledge.
- You have all necessary rights to submit the content (including any media).
- Your content does not infringe any third-party rights or violate any laws.
Important Note: All reports, sightings, and alerts on AlienAlerts.com are user-generated and have not been verified or investigated by us. We do not endorse, guarantee, or warrant the accuracy, completeness, or legitimacy of any report or alert.
5. Prohibited Conduct
You agree not to use the Services to:
- Submit false, misleading, fabricated, or defamatory reports.
- Harass, threaten, stalk, or impersonate any person.
- Upload viruses, malware, spam, or unauthorized commercial content.
- Attempt to gain unauthorized access to the Platform or interfere with its operation.
- Use the Services for any unlawful purpose.
We reserve the right to remove any User Content and to suspend or terminate your account at our sole discretion if these Terms are violated.
6. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information, including location data from reports and alerts.
7. Disclaimers and Limitation of Liability
The Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied.
We expressly disclaim all warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
In no event shall Alien Alerts Network, its owners, operators, affiliates, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim shall not exceed the amount you paid us for membership in the twelve (12) months immediately preceding the claim (or $10 if you have not paid any fees).
Emergency Disclaimer: The SOS feature and all alerts are community-driven tools only. They do not replace calling 911 or contacting official emergency services. In any situation involving danger or emergency, contact local law enforcement or emergency services immediately.
8. Intellectual Property
All content, tools, designs, logos, and materials on the Website (excluding User Content) are the intellectual property of Alien Alerts Network or its licensors and are protected by United States copyright and trademark laws. You may not copy, modify, reproduce, or distribute them without our prior written permission.
9. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately. Paid membership fees are non-refundable except as required by law.
10. Changes to These Terms
We may revise these Terms at any time. The updated Terms will be posted on the Website with a new "Last Updated" date. Your continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.
11. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.
Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in Tucson, Arizona, and you hereby consent to the personal jurisdiction and venue of such courts.
